Can I Still Get an Uncontested Divorce if I Want Spousal Support?

February 25 2020
By Faye Carroll

Yes; Separation and Property Settlement Agreement often contain spousal support provisions.  Although Virginia, as well as some other states have cut back on awarding permanent alimony in favor of temporary or rehabilitative spousal support to encourage the recipient to become self-sufficient, many long-term marriage partners still can agree to and receive indefinite payments of support. Parties may also get limited spousal support if they are the principal caregiver of the couple’s children.

Also, since Virginia recognizes “no fault” divorce, they often don’t even consider who is to blame when granting spousal support.
