What Happens if My Spouse Refuses to Sign the Paperwork After the Divorce Has Been Filed?

February 28 2018
By Faye Carroll

Once your Complaint for Divorce has been filed in a Circuit Court in Virginia, your spouse must either (1)  Accept Service before a Notary Public, or (2) file an Answer to the Complaint within 21 days of receipt.  If he or she does nothing, the case will continue to move forward, and eventually the court will set a date for a scheduling conference.  At this point your case is considered “contested” and our firm cannot represent you on an uncontested basis.

The parties will set trial dates at the Scheduling Conference, and proceed with pre-trial activities such as written discovery, depositions and additional court hearings if necessary.
