What Happens If My Spouse Will Not Sign a Settlement Agreement?

Even a divorce that both parties want and agree to can become complicated and contentious if one party refuses to sign the necessary paperwork. When this happens, your chance of obtaining a simple uncontested divorce diminishes.Ā 

At that point, the only alternative to obtaining a divorce is to file a Complaint for Divorce with the court, and have the Complaint, along with a court Summons served on your spouse by a Sheriff or private process server. The Summons notifies your spouse that a divorce action has been filed and gives them 21 days to respond.

At this point, it will be in their best interest to finally respond to your filing; if they donā€™t respond within 21 days, the court may rule it to be an uncontested divorce.

Assuming your spouse does not file a response, we will file the remaining paperwork for an uncontested divorce.Ā
